Four Documents to Protect Your College Kids
Medical Power of Attorney
So, How Can You Make a Medical Decision For Your Young Adult Child?
- If no documentation is in place, then parents will need to go to Court and be appointed as Guardian of the young adult.
-This takes time, Costs $$, is Frustrating, especially if this is an emergency situation - BUT- if the Child setup a Medical Power of Attorney in advance, then whoever they designate as their Agent (parents, close relative, close friend) can legally make medical decisions without Court approval
Financial Power of Attorney
So, How Do You Access Your Child’s Financial Records?
- A child can grant Financial Power of Attorney before leaving for College,
- BUT if incapacitated, then Parents will need to go to Court and be appointed as a Conservator
Living Will
This document allows your child to specify in advance their end-of-life decisions. For example, if there is a chance of recovery, they can say whether they do or do not want artificial means to keep them alive. They can also specify if they want pain medication to be provided to keep them comfortable, even if it might decrease their life span.
HIPAA-Release
Getting access to medical records for a Young Adult – 3 ways
- A conscious adult who has capacity can provide HIPAA authorization at the hospital- but that assumes that the adult was both conscious and had capacity…
- If unconscious or does not have legal capacity, then Parents will need to go to Court to petition to be appointed as a Guardian of the Young Adult.
- The Young Adult can sign a HIPAA Release prior to leaving for College that authorizes whoever they want to get access to their medical records in the event of an emergency.
